Complaints and Returns Policy

This Complaints and Returns Policy sets forth the principles for submitting and handling complaints, as well as the conditions for returning products purchased from the KINWEAR.PL online store, run by ADKIN Adrian Kinalski (owner: Adrian Kinalski, return and contact address: Jarzębinowa 4/12, 85-627 Bydgoszcz or InPost parcel locker "BYD10A"), e-mail address: shop.kinwear@gmail.com.

1. LEGAL BASIS

Complaints and returns are handled in accordance with the Act of 30 May 2014 on Consumer Rights and the provisions of the Civil Code. The Consumer has the right to goods that are in conformity with the contract and free from physical and legal defects.

2. RIGHT TO COMPLAINT (CONFORMITY OF GOODS WITH THE CONTRACT)

The Seller is liable to the Consumer for the conformity of the goods with the contract for a period of two years from the date of delivery. In the event of non-conformity of the goods with the contract, the Consumer may request:

  • repair of the product,

  • replacement of the product with a new one,

  • price reduction or withdrawal from the contract – if the defect is significant.

Complaints should be submitted in writing or electronically to the e-mail address: shop.kinwear@gmail.com, describing the problem and attaching photos of the product (if possible). The Seller shall consider the complaint within 14 calendar days from the date of its receipt and inform the Consumer of the resolution. In the event of a complaint being accepted, the costs of repair, replacement, and delivery shall be borne by the Seller.

3. PERSONALIZED PRODUCTS

Products offered by KINWEAR (e.g., name embroidery, individual designs, clothing sewn or embroidered to order) are made according to the Client's specifications and are not subject to return or exchange once the project realization has begun. Pursuant to Art. 38 point 3 of the Consumer Rights Act, the right of withdrawal from a distance contract does not apply to non-prefabricated goods, produced according to the consumer's specifications or intended to satisfy their individual needs.

The Client approves the design before implementation begins. Once the design is approved, order cancellation is not possible. In the case of resignation before implementation begins, the Seller may deduct the design development costs (e.g., 85 PLN). The Seller is not responsible for errors in the embroidery content or design if they result from data approved by the Client.

4. COLOR AND VISUAL DIFFERENCES

Despite best efforts, the actual color of the embroidery or thread shades may differ slightly from the design visualization. Differences may result from screen settings, photo quality, lighting, or the availability of specific thread shades. Such differences do not constitute a product defect and are not grounds for a complaint or withdrawal from the contract.

5. RIGHT OF WITHDRAWAL (RETURN)

The Consumer has the right to withdraw from the contract within 14 days of receiving the product, except for the cases referred to in Art. 38 of the Consumer Rights Act (including personalized products).

In the event of an incorrect indication of the product type in the order or incorrect size selection, exchange or return is not possible. The Seller is not responsible for the choice of the wrong size, color, pattern, or type of product. The Client bears full responsibility for the correctness of the provided data. Products made to individual order are not subject to exchange or return, even if the client made a choice from ready-made patterns but specified the size, color, or other product parameters themselves.

To exercise the right of withdrawal, a completed withdrawal form (Annex No. 1) must be sent to the e-mail address: shop.kinwear@gmail.com. The product should be sent back in an unaltered, unused state, in the original packaging, to the Seller's registered address within 14 days from the date of submitting the declaration of withdrawal. The Seller refunds the Client the cost of the goods and the cheapest delivery cost offered within 14 days from the date of receiving the returned product.

7. FINAL PROVISIONS

In matters not covered by this Policy, the provisions of the Civil Code and the Consumer Rights Act shall apply. The Consumer has the possibility to use out-of-court dispute resolution methods. The Policy is effective from the date of its publication on the Store's website and constitutes an integral part of the KINWEAR.PL Regulations.
